The nature of delegation case in Islamic law and ijtihad institutions

The ijtihad which is handled under the umbrella of Islamic law and carried out by the fiqh assemblies on the advancement of technology, differentiation of transportation vehicles, advancement of medical treatment methods and so on in the Islamic world is called committee ijtihad. The difficulty and complexity of the problems and events that occur in our time and their close relationship with more than one science have made it imperative that scientists who are experts in their fields to come together and produce solutions. This situation has led to the need for scientists who are experts in different fields to come together and work as a committee. It is possible to translate the concept, known as "الاجتهاد الجماعي " into our language with expressions such as "jamaat ijtihad", "group ijtihad", "collective ijtihad", "community ijtihad", "committee ijtihad" and so on. The committee ijtihad is one of the methods of fuqaha producing solutions due to the increase in the solution ways in the face of the increase in the needs of the people and the formation of scientific disciplines and the close relationship of multiple branches of science. Some books and articles on the subject have been written in Arabic. However, there is no academic study or book in our country other than a few articles on this subject. This study consists of an introduction, two parts and a conclusion. In the introduction part, technical information about the subject, its importance and the method of our study is given. In the first part, information is given about the definition of the committee ijtihad, the importance of the committee ijtihad, the definition of shura and ijma, the difference between the committee ijtihad and ijma, the historical course of the committee ijtihad, the conditions used in the committee ijtihad and the judgment of the ijtihad. In the second part, information about the need for committee ijtihad today, the function of the committee ijtihad and the role of the fiqh assemblies established in the Islamic world in implementing the committee ijtihad are given. In the conclusion part, a general evaluation has been made on the committee ijtihad.
