Abstract (EN)
Kismet-i Askeriyye Court sidjil is a registry which contains 405 cases and has been viewed between A.H.1159-1163 (A.D.1746-1750) in 98 leaflet registries numbered 114 belonging to İstanbul Kısmet-i Askeriyye Court. In this thesis, which consists of two chapters, apart from the transcription of the registry, it is also included in a separate section dealing with the Ottoman law of heritage and its cases in the register. In this study, it is focused to reveal the Ottoman inheritance law practices in the context of court records in a time to the transition period of the Ottoman Empire from the classical period to the modernization period. In this record, which does not include the stock accounts of the heirs, contains the determination of the draft, solution of the law collusion issues of the heirs, the debts and debts of the deceased, the status of the slaves in the inheritance, the effect of the will on the inheritance division (inheritance law).In the case of inheritance law and concepts such as beyyine (evidence), ikrȃr (acceptance), denial (rejection), tahlif (juration), deed (debt), hüccet (deed), murur-ı zaman (time-out), which are effective in establishing judgments in lawsuits, importance and effect was revealed.
