Abstract (EN)

Data security; These are protective security measures that are created to protect data against unauthorized access and use, and ensure that only the data owner and those who have the explicit consent (approval) of the data owner can access and use the data. Data security is a very important issue in today's rapidly advancing technology. Smart devices, portable phone, tablet, voice recording, etc. With the spread of personal use of such devices, the dissemination of data becomes easier. For this reason, although personal precautions are taken, ensuring data security in daily life has come to a difficult point. Personal data protection law; individuals have a private life within the framework of their fundamental rights and freedoms under the guarantee of the Constitution, as well as freedom of expression, freedom of communication etc. as an extension of their personal rights. accepts that they have many kinds of freedoms and that they should not be restricted or threatened over their personal data while using these freedoms. In this framework, it introduces laws and regulations on behalf of the protection of personal data in the legal order. With the Constitutional amendment made with the Law No. 5982, "the right to privacy and protection of private life" was added to Article 20 of the Constitution, and with this article, the protection of personal data was guaranteed by the Constitution. Thus, the necessity of protecting data within the framework of individual rights and freedoms is guaranteed by the Constitution. In this master's thesis, the protection of personal data has been evaluated in terms of Constitutional Law. In the thesis study, which consists of three parts, the introduction, the first and the second part, and prepared with the literature research method; In the introduction part, the general framework of the thesis was drawn, in the first part, general literature on subjects such as personal data and protection of personal data was presented, and in the second and last part, the protection of personal data within the framework of the Constitutional Law was discussed.
