Abstract (EN)
A comprehensive understanding of a legal concept is only possible through an examination of its origins, historical development, and the manner in which it has been received into the modern legal order. In this regard, the study aims to explore the foundations of the concept of shared ownership (communio) in Roman law to analyze the relevant legal rules developed during the Classical Period of Roman law and ultimately to identify the similarities and differences between this historical perspective and the approach adopted by contemporary legal systems. Accordingly, the first part of the study examines the concept of communio and its historical development within Roman law. The second part focuses on the circumstances under which shared ownership arises in Roman legal doctrine. The third part addresses the legal relationships among shared owners, including their rights and obligations. Finally, the fourth part analyzes the actio communi dividundo, the legal action by which shared ownership could be terminated in Roman law.
