Abstract (EN)

In our thesis entitled "Cultural Property Trafficking Crime and Illicit Cultural Property Trade Crimes", primarily the terms related to cultural property are defined. Subsequently, the development of Turkey concerning the protection of the cultural property is discussed. The research started from the times when there is no regulation specific to cultural properties. After the national regulations were addressed, the international regulations on the smuggling of cultural properties were also taken into consideration.. International organizations that have contributed to the realization of these regulations are also briefly mentioned. At the end of the chapter, the rationale for applying to criminal law on the protection of cultural properties is mentioned. In the next parts of the study, the crimes in the Law on Protection of Cultural and Natural Properties, numbered 2863, will be discussed. While examining the crimes, the elements of the crimes and the specific situations of these crimes were discussed. General definitions and information common to all three crimes have been examined under the heading of the crime of trade of cultural and natural properties (Article 67/2), which is the first crime to be dealt with, and repetition is avoided in the following sections. With the study, attention was drawn to the legislation and practice in terms of combating the illegal introduction of cultural properties into commercial life.
