Abstract (EN)
By the improvement of technology and the accruing of the new criminality domains; the influence of organised criminality has increased on existing legal system; whereupon the governments seek for the new methods to contend with the organised criminality. In this context; governments assent the new protective measures by innovating some points on either national and international legal systems.In the cases that no other protective measures come by with evidences, the legislators assent this undercover agent measure by the reason that this measure intermeddles individuals rights and freedoms and also it is the one of the most efficient method to contend with the organised criminality. The crimes that the undercover agent measure executed have to differentiated and restricted from the other crimes by the counting method from the catalog and also the scope of the crimes will be emphasized by the law executers depending on determination of general principles of this crimes.The execution of undercover agent measure is only managed by law therefore this execution necessitates the person who is nominated as undercover agent can only act and come by with the evidences within the law. Otherwise, those evidences will be described as unlawful evidences so they will be never used in crime proceeding.In the case of a crime of undercover agent while he is performing his mission, the question that the undercover agent is held liable or not for his crime is tried to expounded by the arrengements in the materially and technically criminal law.
