Intra-secterian preference and it's method in Shafi'îs

This study, which deals with the intra-sectarian preference process in the Shafi'i sect, consists of introduction, conclusion and three parts. In the introduction part, the subject, purpose, sources and method of the research have been discussed. In addition to this, detailed information about both Turkish and Arabic literature related to the study has been tried to be given. In the first chapter, which aims to reveal the nature of intra-sectarian preference, first of all, the definition, types, beginning and continuity of intra-sectarian preference have been examined. Then, the elements of preference, its subject, purpose, reasons for preference and its relationship with other fiqh inference methods have been examined. In the second part, it has been aimed to understand the subject better by examining the necessity of intra-sectarian preference and the bindingness of the preferred opinion in terms of mujtahid mufti, mukallid mufti and mustafti. In the third chapter, the nature, subject, aim and addressee of the intra-sectarian preference method have been discussed. In particular, the preference principles based on the person and the work, which are included in the subject of this procedure, have a special importance. Because in person-centered preference, preference criteria to be applied between different opinions of Imam Shafii and other mujtahids belonging to the sect are important. And also there is same situation in the work-centered preference principles. In the conclusion part of the study, the findings reached have been revealed.
