Administrative law enforcement measures for the protection of public health during dangerous epidemics and their limits

Public order, which expresses living in the peace and security of societies, is the state of being regularly provided for certain elements. One of these factors mentioned is general health. In order to maintain the public order of the administration, it is often necessary to apply to law enforcement applications. On the other hand, the necessity of using regular and public power in law enforcement results in interference with fundamental rights and freedoms.Fundamental rights and freedoms will inevitably be limited as a result of the administration's recourse to law enforcement measures in the field of general health, which is an element of public order. The conditions of these restrictions are regulated separately for the ordinary and extraordinary periods in the Constitution. The purpose of this study is to discuss the legality of law enforcement activities carried out for general health reasons within the framework of the principles of constitutional and administrative law. The definition of the term "administrative law enforcement" in the first chapter of the thesis, the examination of the parts emanating from the judicial law enforcement, the forms of public order, the elements of public order and the restrictions of fundamental rights and freedoms in judicial decision-making places, essentially the limitation of fundamental rights and freedoms within the borders of the law enforcement, and the options of the State of Emergency, in which the law enforcement authority is expanded, by considering the restriction of fundamental rights and freedoms; In the second part, the dangerous growth period of law enforcement activities in the field of general health examples of law enforcement practices, administrative administrative action theory and the effect of the limitation regime of fundamental rights and freedoms in Article 13 of the Constitution on law enforcement activities are discussed.
