Abstract (EN)

The subject of the thesis is `?Collective Redundance??. In our law,Labour law no 4857 with collective redundance that be arranged asinternational norm. When arrangement in law is examined, the CollectiveRedundance?s description appaers to be so: a determined number of employeeare discharged for economical reasons with a decision employment terminationof a given number in a given period of time.The thesis is formed of three parts:In first part, international norms relating to the matter of collectiveredundancy is examined. Legal arrangements relating to collective redundancyis examined, especially those in France, Germany and Switzerland, Italy andAzerbaijan?s Law as an example from the east. Also in this part, the legalarrangement from Labour law no 3008 to Labour law no 4857 in Turkish Lawis examined. The concept of the collective redundancy has been tried to bepointed out in this way.The second part of the thesis is ?Characteristics of CollectiveRedundance and Obligations Of The Employer?. In this part, the reasons ofcollective redundance, its duration and which rate or number of employee areneeded to be discharged from work have been mentioned. Also, in this part,cases that don?t qualify as collective redundancy have been examined. In suchcases, eventhough there is a collective redundancy that is taking place, thejudgements of collective redundancy is not applied.
