Abstract (EN)

In this study, the obligations of the legislative body concerning law-making and the phenomenon of non-fulfilment of these obligations are analysed. There are many duties and powers specified in the Constitution as belonging to the legislative body. Undoubtedly, the most crucial duty and power of the legislative body is to make laws. In this context, the legislative body has important duties. In this study, it is analysed how the constitutional rules regarding the law-making activity of the legislative body should be interpreted, how international law has an impact on the obligations of the legislative body, and finally, how the judicial body, which is responsible for constitutional judicial review, interacts with the legislative body in terms of legislative activity. In this context, the concept of "legislative omission" is analysed and its history and reflections in comparative law are explained. In the light of these explanations, the omissions of the legislative body in Turkey are assessed. Finally, it is presented how the Constitutional Court has addressed the issue.
