Abstract (EN)
In the frame of the impact of technological developments on legal systems, the effect of digital data, which are being received through digital methods, on criminal procedure as a piece of evidence is a highly controversial topic. As these data are quite fragile and there are some important problems about their authenticity, their mere presence in the court decisions may cause unfair results. This article examines what the digital data are and it tries to attach the digital data to general theories of evidence in criminal procedure law. It analyses how the digital data are prepared and presented as digital evidence and how the courts consider them.
