Abstract (EN)
The aim of our thesis is to scrutinize the crime of forgery of official documents in our law based on the crime of forgery of official documents regulated in the Turkish Penal Code. It is aimed to scrutinize the regulation of the crime of forgery of official documents and to create suggestions on the subject, within this framework. In our thesis; firstly, the historical development of the crime is outlined and then the basic and common concepts of the crime of forgery of official documents are mentioned. In accordance with the "classical method of crime type examination", the elements of the crime of forgery of official documents, its qualified forms affecting the crime, and its special forms of appearance have been examined separately. In addition, a comparison has been made between the provisions of the TPC numbered 5237 and the provisions of the former TPC numbered 765. In the examination, it has been utilized from the opinions in the doctrine, judicial decisions and, when necessary, comparative law, in addition to the legislation, which are the main sources of the crime. In our thesis, after the opinions on controversial issues have been exposed, solutions have been tried to be exposed by stating personal opinions. As a result of our thesis study; it has been determined that the concept of document, which is especially the basic concept of the crime of forgery of official documents, should be interpreted correctly according to today's life relations and technological development and that the practices under the provisions of the abrogated former TPC numbered 765 should change. The importance of the correct determination of the concept of document in the application of crime, the correct exposition of the relationship between the crime of forgery of official documents and other crimes, the correct implementation of especially the provisions of solidarity and aggregation, in terms of criminal justice has been exposed.
