Abstract (EN)
SUMMARY PAID AND UNPAID VACATIONS IN TURKISH LABOR LAW Since human effort is not unlimited by nature, working hours and vacation days are regulated by International Institutions, especially by International Labor Organisation (ILO). According to those regulations, each country can make its own arrangements about working hours and daily, weekly and annually vacation times Tor its workers. The same regulations are made mainly by Turkish Constitution and Turkish labor laws. According to those regulations, workers have some rights; such as break during working hours, weekend and annual vacation after completing their regular working requirements, in addition those rights, workers also have vacations for sickness, marriage, national and general holidays. Since break during working hours is not regarded as a working hours, workers are not paid for weekly, annually, national and general holiday, sickness and marriage vacations. Paid and unpaid vacations mentioned above are regulated by collective bargaining agreement in workplaces. Collective bargaining agreements in workplaces can provide advantages on behalf of workers instead of disadvantages in the circumstances of paid and unpaid vacations referring to the Turkish labor law. Practices show that advantages overweight disadvantages.
