Abstract (EN)
Public administration aims strengthening financial and economic structures of incorporations, creating funds and supporting growth with capital gain tax exemptions on immovable property and subsidiary share sales. First, it has been in force in 1984 in Turkish tax system, it has been widespread and an important tax exemption by incorporations. While this exemption has been explained in a few paragraphs in Corporate Income Tax, it has been guided by the explanations issued in Special Opinions. Therefore, there are several different opinions in unclear issues related to application of the exemption. Unclear issues have been reviewed in our thesis and it has been tried to explain these issues within the tax system. Tax Administration should issue an extensive regulation in order for guiding the application of the exemption and abolish unclear issues.
