Abstract (EN)

The history of asylum, immigration and refuge all of which are socially dubbed immigration is as old as the history of humankind. As a result of natural disasters, climatic conditions, wars or human rights violations caused by oppressive regimes, people in struggle to survive bring about both individual and massive population movements. Their own countries'not being able or not wanting to protect those who are bedevilled by these population movements emerged the international protection. Government have some obligations as protecting and guaranteeing the basic rights and freedoms of their citizens at both international and national levels. In circumstances in which the mentioned rights and freedoms are not or could not be protected by the country of origin, the country or the countries into which the individuls demanded to refuge are obliged to better the rights of people demanding to refuge by taking them under guarantee. These people's being sent back to the countries where they are hang by a thread or their being deported is not possible in terms of international law. They, on the other hand, are required to enable these people to benefit from the rights from which the other foreigners benefit in the country and not to discriminate. These requirements stem from humanist law, their habitual rules, international agreements to which they are side of, and court decisions taken by bodies such as international court of justice (icj) or European court of human rights. The subject is the benefiting of refugees, asylum-seekers, stateless or immigrants, admitted to be foreigners, from rights and freedoms at both national and international levels at least in the minimum basis and their being taken under protection in this regard.
