Abstract (EN)

In the conditions of Turkey, with the increasing awareness of the employees in both the private sector and public institutions and organizations about the phenomenon of mobbing, both academic studies and the number of cases related to the subject have been following an increasing trend, especially between the years of 2006-2021. Despite the intense mobbing processes among those working in public institutions and organizations, it cannot be said that public employees have reached a sufficient level in terms of seeking rights. Mobbing cases occurring in public institutions and organizations are handled within the framework of high judicial decisions. In mobbing cases, the adequacy of the regulations in positive law, the need for exceptional situations compared to the current regulations regarding the proof of mobbing, the intersection and divergence of high judicial decisions have been identified.
