Abstract (EN)

It is very important that higher education system should be carried on in accordance with its function. For a qualified higher education system, a qualified education, qualified researches and qualified services for the society are also necessary. There are some necessities for a higher education system to carry out its functions such as education and training, doing researches and serving the public. These necessities vary from basic principles of higher education system to its practices, from academicians to administrators and from control system to financial running. Therefore, higher education system is needed to be examined comprehensively and deeply. This research has been done with the aim of enlightening the innovative approaches in this regard. In the research the qualitative research method is used, and the law draft of higher education, published in 2012, has been handled. The opinions of universities, academicians, NGOs and state institutions and organizations-intended for this law draft- have been examined according to document analysis. Afterwards, these opinions have been separated to themes and subthemes by making content analysis and descriptive analysis. It has also been described to what extent these opinions reflected on the law draft-published by being corrected in 2013. In the research, updated practices (the law no. 2547), requested changes with new law draft, opinions about this law and suggestions as part of national and international body of literatures have been improved. It is a positive practice in terms of transparency that receiving opinions of universities, academicians, NGOs and state institutions and organisations; sharing opinions through the internet and informing about the process during the preparations of law. However; the opinions of universities, academicians, NGOs, state institutes and organisations collected towards initial state of law have not mostly reflected to the final state of the law according to research findings. At this point, it is understood that finalisation stage of law draft started in accordance with transparency did not meet the expectations. Most of the opinions are of the universities, and the ones that express their opinions at the least are state institutes and organisations. Academicians mostly present their opinions about articles of personal rights. It has been observed inconsistencies in the draft context itself. In some articles, there are some judicial mistakes or deficiencies, contradictory statements mentioned hereinabove. While some articles are in a general framework, some others have been written in the style of regulations. In this research, new suggestions have been offered about a new draft according to articles and parts in the light of all findings. Keywords: higher education, law of higher education, law draft of higher education, higher education law draft, higher education management
