Implementation of the fundemental rights and freedoms which were guarented under the Turkish Republics 1982 dated constitution, in 5237 numbered Turkish Criminal Act

The people have some rights which are indiscriminated like race, sex and language.These rights didn?t given to them from a government or discipline; these rights given themonly by their humanity; they got them when they fallen to the venter. So these rights don?talienated and abandoned.The care of these rights effectively is duty of the government. The governmentarranges these rights and guard their infringes by the punishments.At the past, the civil law seen that it couldn?t sufficient for the arrange of these rightsand guarantee; so by international engagements these rights approvabled.In this study of thesis, first; the Concept of Main Rights and Freedom; after that, theactions that infringe the Main Rights and Freedom in Constitution of 1982, also the mainsource of the punishment law that effected at 01.04.2005 as a Turkish Punishment Law andthe legal entity of these crimes will be explained.
