SUMMARYMaster Thesisi25 Number at Kal?abend NotebookSuha Oğuz BAYTİMURUniversity of FiratThe Institute of Scial SecienceAnd Postgraduate Study in History2005; Page: IX+250Ottoman State kept in mind Islamic Law while constructing its Judicial System.Moreover; social structure, needs of whole society, and all conditions of the term have playedgreat role in formation of Judicial System. The study we have made clarifies this situation.On the other hand, Judicial System of Ottomans was performed by Kadıs at courts inthe subdivision of the provinces. All formal complaints submitted to the centre in the event ofunjust treatment in the borders of the State have been usually considered at the courts of theregion where the events have occured by officials.Ottoman State have tried to get under control all acts that are foolish or morally wronghowever in case of criminal offenses have not hesitated to interfere. It has been showed greatcare to protect people?s rights and social order. In this time, also, Ottoman State used topunish the criminals by rough treatment because they have broken the law or done somethingwrong. The ways of punishments determined in this study were imprisonment in a citadel,exile, obligatory residence, and confiscation. It was not the aim to exclude criminals fromthe membership of the society; on the contrary, Ottoman State aimed to control and changeways of criminals.Key Words: Exile, Imprisonment, Kal?abend
