Abstract (EN)
The Ottoman Justice System based on laws known as ?Şer?î naslar? and Ulul-Emr? put into effect by the head of the state which is not against the sharias. It is possible to see the implementations of the ?seri? and ?orfi? laws on ?seriyye sicils?. The siciller (sicils) were recorded by the muslim judges?kadi? in chronological order. Not only did these records include such documents called ?ilâm, hüccet, mürasele? together with these they include ?ferman, hükümler, emir and tebligat? which were sent by the head of the state as well. The records on ?seriyye sicils? are guarantee of securing the rights and these records are significant in terms of local historiography. Many issues have been resolved pertinent to the history of the cities based on the ?seriyye Sicils?. These ?sicils? reflect military, political, economic, social, cultural, as well as the legal status of the period. They are one of the crucial historical resources in order to comprehend the events taking place specific period of time. In this study, ?418 Numaralı Manisa Şer?iyye Sicil Defteri? has been examined. The ?defter? is belong to Kula, which is a town connected to Manisa. The ?sicils? of this town are involved in ?Manisa Şer?iyye Sicils? since it does not has own separate records. The ?seriyye Defters? were recorded according to matter in dispute on the last period of the Ottomans. The ?defter?, which we examine, were recorded (held) as a ?vekâlet defter? belong to Kula. This study consists of introduction and four main sections. In the introduction, the geographical position and historical situation of the Kula are discussed. Afterwards, the first section is covered by the general and basic information regarding to the Ottoman Justice System and Courts. The transcribed of the ?sicil defters? are found at the second section, the summarizes of the documents are mentioned at the third section, and general assessment of the ?sicil? is made at the fourth section. This study culminates with the conclusion and bibliography.
