Working extra hours in Labour Law No 4857

Limiting working hours is the priority issue of the labour law shaped as a conservation law, even reasons of emergence of it.If there isn't a limited working hour concept,working extra hours can't also be mentioned.Therefore it is necessary to urge upon limits brought to working hours and exceeding the limits. For the overworking and working extra hours concepts arranged in the Labour Law no 4857, head piece of working extra hours is used.In this study,extra work and working extra time were basically analyzed in the meaning of Labour Law no 4857 and they are partly tried to be correlated with Maritime Labor Law no 854, Coordination of the Relationship between Employees and Employers in Press Sector Law No 5953 and Turkish Code of Obligations Law no 6098.Also in our whole study, assessments regarding settled judicial decisions were included. In the first part of the study, the historical development concerning restricting working hours, legal basis' of extra work and similar concepts arranged in Law no 4857 were tried to be explained by correlating extra work.In the second part, firstly, kinds and conditions of extra work,limits brought to working hours and then besides demonstration problems regarding extra work,equity reduction which have a wide place in application were dwelt on.In the last part, overtime pay which is the cover for extra work and the conditions of giving leisure time were analyzed.The results depending on not giving the cover of extra work on time were also tried to be analyzed.
