Abstract (EN)
This study is named as "The Stipulations for Being Insured According to the Social Security Act number 506" and since being insured is a prerequisite in order to benefit from the social securities, how to get this right in case the individual is obliged to be insured which constitutes a part of the application of the Act number 506 is the subject matter of the study. In the first part of the study, the historical development of being insured in Turkey is explained. Then, after an explanation of the general concepts pertaining to the subject, the legal relations and individuals that play a role in having the right to be insured are described. In the second part of the study, while staying in agreement with the Clause 2 of the Act number 506, the conditions for the employed of being obliged as insured are examined. Among these conditions, firstly working according to the service agreement is scrutinized in full detail and then the condition of working in the workplace of the employer is investigated. Finally the chapter is ended with an examination of the condition of not being an individual indicated in the Social Securities Act number 506 Clause 3. In the third and final chapter the individuals that the legislator includes in the Social Security Act number 506 although not having a service agreement, along with the others who are recognized as insured with the exception of Clause 3 are examined. Moreover, the study is ended with an explanation of singularity in the Social Securities. Since the legislator takes into account the socio-economic conditions and have a reqirement for the social protection, a framework is given in this study for those individuals who are obliged to be insured according to the Social Securities Act.
