Abstract (EN)
Tender fraud crime is regulated in Article 235 of the Turkish Panel Code (TPC) No. 5237. Crime in law systematics is included in the ninth part titled "Offences Against the Economy, Industry and Trade" which is under the third chapter named "Offences Against the Public" of the second volume named "Special Provisions". The disorganization in the previous penal code, the Turkish Panel Code No. 765, was ended; and the crime has been regulated under a single article of law and as alternative moving action in the Law No. 5237. In addition, Article 235 of the aforementioned law has been amended with article 12 of Law no. 6459, also known as the Fourth Judicial Reform Package in public. This study covers the tender fraud crime based on latest amendments in TCC. As tender is the main subject matter of the crime, tender and related concepts has been explained in this study. Due to the fact that the tender requires expertise, basic information on tenders has also been covered. The legislation about tender fraud crime has been examind in detail and the evaluation was carried out both theoretically and practically by making use of the views in the doctrine and Supreme Court of Appeals decisions.
