Criminal liability arising from trademark infringement through quotation or confusion in Insudtrial Property Law numbered 6769

In order to protect trademark, which has an important role in commercial life, by means of criminal and civil law national and international regulations have been made. One of the criminal law protections provided to the trademark in Turkish law is the crime of infringement of the trademark right by means of quotation or confusion. In the first paragraph of Article 30 of the Industrial Property Law, some acts committed by using a sign that is the same or similar to the registered trademark belonging to someone else on the goods or services subject to registration are subject to criminal sanctions. This regulation is in compliance with the criminal protection provided to the trademark right included in TRIPS, which is an international agreement to which we are a party. Since the regulations on criminal protection of trademark rights were made in the second half of the 20th century, these regulations naturally contain some deficiencies. In our study, we tried to identify the deficiencies in the current regulation and offer solutions for them. These new law texts has contained some deficiency. In our study, we tried to find the these deficiencies and offer solution suggestions.
