Abstract (EN)
This study analyzes the impact of the European Court of Human Rights (ECtHR) jurisprudence on the legal and judicial frameworks in Turkey concerning the right to a fair trial. The right to a fair trial is recognized as a fundamental right aimed at protecting individuals' basic rights and freedoms and is regarded as one of the core principles of democratic constitutional states. By addressing the historical and conceptual development of the right to a fair trial, the study examines its components within the framework of Article 6 of the European Convention on Human Rights (ECHR). The effects of the ECtHR's judgments, rendered in response to individual applications, on Turkey's judicial system are assessed, and the constitutional and legislative reforms undertaken to align with the Convention's standards are discussed. Furthermore, the reflection of ECtHR jurisprudence on the Turkish legal system is evaluated in the context of the alignment of domestic regulations with international human rights norms. This study underscores the practical significance of the fair trial standards envisaged by the ECHR and examines their multifaceted influence on judicial processes in Turkey. The findings aim to contribute to understanding the transformations brought about by being a party to the ECHR in national legal systems and evaluating the effective implementation of the right to a fair trial.
