Fuel dealership agreement

In this study, fuel dealership agreement has been analysed with regard to both Obligation Law and Competition Law. In the first chapter of thesis, definition of dealership agreement, its elements, the differences of dealership agreement from similar agreement types has been emphasized. Fuel dealership agreement is contract which dealer sell fuel his own behalf and for his own account and perform activities aimed at increasing the sales as it included in the distribution network. In the second chapter of this study, rights and obligations of parties of agreement has been examined. In addition to in this chapter, right of usufruct which is mostly used in fuel oil sector has been mentioned. Particularly relation between usufruct and competition law has been specifically dealt. Furthermore, in fuel dealership agreement, issues such as resale price fixing and passing risk has been reviewed. As a result, in the third and last chapter, termination of dealer agreement has been considered. Grounds of termiantion of fuel dealership agreement has been examined. Additionaly, grounds for the termination of the usufruct has been mentioned. Effects on termination of usufruct and dealer agreement has been evaluated.
