The arbitraments and attendants of assignment of claims

The concept of assignment of claims has been resolved under the ?General Provisions? section of the First Part of the Code of Obligations and it comprises of the debtor, creditor, and third person. The fact that the assignment of claims, which can be implemented for various purposes, provides a significant opportunity for the creditor in achieving its objective and the fact that it is a frequently utilized concept in practice owing to this previously mentioned characteristic, has been the prominent reason for the preparation of this study. In a creditor-debtor relationship (obligation) the parties of the relationship are the creditor and the debtor. The passive party of this relationship consists of the debtor and the active party consists of the creditor. In the assignment of claims, a third party is included among these parties and the active creditor party changes.The study is constituted of an introduction, three main sections, and a conclusion. After an introduction to the subject, in the first section, the concept of the assignment of a claim, which constitutes the basis of the subject, has been defined, its types and conditions have been determined, and reserved provisions concerning the pledge to assign claims that can not be assigned, and the assignment of claims have been emphasized. In the second section, the relation of the concept of assignment of claims with other similar concepts and its differences to these concepts have been examined. In the third section, after the main subject has been elaborated and major and secondary outcomes of the assignment of claims have been underlined, the provisions and outcomes of the assignment of claims arising in terms of the concerned parties have been examined in detail. In the conclusion section, results obtained from the study have been put forth in the form of a summary.Key Words: Conveyancing, Trigeminal Debtor-Creditor Relationship.
