Abstract (EN)
The rapid increase in the impact of artificial intelligence-supported products on our lives has highlighted the importance of determining legal liability in terms of potential disputes. In this context, our study first examined artificial intelligence and artificial intelligence-supported products from technical and legal perspectives. After establishing a conceptual framework, artificial intelligence technologies around the world and the regulations established for this technology were analysed comparatively prior to detailed analysis. After reviewing international regulations, the current state of artificial intelligence technologies, and recent developments in the field of law, the relationship between artificial intelligence-powered products and will was examined in the context of the concepts of automation and autonomy. The concepts of will and algorithmic will were analysed from both legal and technical perspectives. In this context, algorithmic will was addressed with a distinct distinction between limited and full-capacity capabilities. Provisions in our legislation that can be directly or analogously applied to artificial intelligence-supported products have been analysed, and the inadequacy of these provisions, particularly for artificial intelligence-supported products with full algorithmic will capacity, has been highlighted. In the final section, e-personhood and e-registration systems for artificial intelligence-supported products with algorithmic will capacity have been evaluated as a de lege ferenda solution proposal. In our study, the liability arising from the use of artificial intelligence-enabled products in the context of algorithmic decision-making capacity has been analysed from a legal perspective within a systematic framework through normative analysis, conceptual distinctions, case law review, and comparative legal analysis.
