Abstract (EN)

The subcontracting agreement is a kind of contract within the scope of the contracts for work and labor that is defined in Turkish Code of Obligations. This contract sets out the terms and conditions between a contractor and subcontractor for the provision of services to a third party (contract giver). When an individual or a company is involved in a large-scale project, a contractor is often hired to see that the work is done. The contractor, however, rarely does all the work. The work that remains is performed by subcontractors, who are under contract to the contractor, who is usually designated the "general" or "prime contractor. "Subcontractors may, in turn, hire their own subcontractors to do part of the work that they have contracted to perform. The main contractor is still in charge and must oversee hires to ensure project is executed and completed as specified in contract. In this study I give information about parties, elementsand qualificationsof subcontracting agreement, the similarities and differences from other agreements, the liability of subcontractor and the termination of the subcontracting.
