The idea of constitutionalism in the Constitutional Law

Our master thesis, titled "The Idea of Constitutionalism in the Constitutional Law", consists of the introduction, three main chapters, and the conclusions. In this study, it was examined how constitutionalism idea was discussed in the field of constitutional law and which principles and institutions were covered. In order for the study to be better understood, the state and sovereign concepts, which are directly related to the constitutionalism, are briefly explained in the introduction and provide a basis for understanding the question of why constitutionalism idea is important. In this context, in the first part of the study, the term of constitutionalism, its types and its relation with other issues such as constitution and democracy, which form the basis of constitutional law, are discussed and the historical development of constitutionalism in theoretical and practical terms is discussed. In particular, the British, American and French revolutions, as the historical background of the idea of constitutionalism, have an important place in this study in terms of the movements of constitutionalism. In the second part of the study, the separation of powers, which we can consider indispensable in order to protect the freedom of individuals by limiting state bodies, is examined in the perspective of constitutionalism. In the third and final part of the study, the historical development and needs of the rule of law are emphasized by focusing on the rule of law rather than on the rule of a man so that the individual can live a decent life for free and human dignity.
