Abstract (EN)

In this study, the thought of human rights and freedoms in various thought systems with the impact of political, economic, scientific, religious and social events, the evolution of the legal documentation process in the world and Turkey are examined. Due to violations of human rights and freedoms in World War II, in this process of evolution, the emphasis on the principle of human dignity in the emerging international conventions and constitutions has been investigated in this study. From an abstract and unclear thinking system of human rights and freedoms, to concrete and as norms applicable to life transferring the treaties were signed in the international platforms and national legal systems of states as constitutional norms; in other words, in other words, in national and international positive law of states the process of identification and recognition of human rights and freedoms are examined; processes of determination of the area of protection and norm areas and norm concretization by the right or freedom are investigated. Considering the dynamic structure of human rights and freedoms are evaluated that not included as the norm of rights or freedom in constitutional texts unrecognized in positive law controversial about human rights and freedoms issues such as euthanasia, abortion, right to be forgotten, conscientious objection, human rights violations as a result of scientific and medical developments.
