Abstract (EN)

Today, it is not possible to resolve many disputes only with legal knowledge. The Expert's technical or specialized knowledge is often needed for the trier of fact to reach correct and fair judgments and for those who are parties to a case to submit their own claims and defenses properly. Given the current progress of science and technology, there is no doubt that this need will continue to increase. However, the transfer of technical and specialized knowledge to the legal field through experts also raises problems. Different legal systems have made different choices to overcome these problems and to transfer technical and specialized knowledge in accordance with the intended purposes in the proceedings. The aim of this study is to examine expert witnesses regulated in Turkey where the continental legal system is embraced and expert witnesses regulated in the United States of America and England, where the Anglo American Legal System is applied and to compare them to each other and to provide some information about some practices that are considered to be beneficial for our country.
