The principle of equal treatment is arranged for the first time, but it has been accepted by doctrine and Supreme Court for a long time, with Turkish Commercial Code, no: 6201. The Board of Directors, which is the management body of the joint stock company, is obliged to observe this principle in its decisions. In the justification of rule that the decisions of the Board of Directors, which are contrary to the principle of equal treatment, are the most common encountered decisions in practice and void ruling sanctions are envisaged in terms of these decisions. The purpose of the present study is to try to analize the principle of equal treatment in board of directors with its legal results.
