Abstract (EN)
The "State Affiliated with Atatürk's Nationalism", which is listed in Article 2 of the 1982 Constitution and is among the characteristics of the state, is discussed in the context of the principle of Atatürk's Nationalism in terms of both Constitutional law and Administrative law. In terms of constitutional law, the quality of being a state depending on Atatürk's nationalism, which is considered in the studies where qualities such as the secular state, the democratic state, the social state, and the rule of law are discussed together, can find a certain place in the literature of Constitutional Law. However, while describing the nature of the state, it can be stated that the studies dealing with the principle of Atatürk's Nationalism, which include the views on what should be understood from the element of nation that constitutes the structure of the state, are of a more remarkable quality. In terms of administrative law, this principle is handled in a way that turns the direction towards Constitutional Law, just like the Constitutional principles to which the Administration is bound, and dimensions such as the establishment, duties and activities of the Administration are not directly addressed with this principle. With this study, the importance of the principle of Atatürk's Nationalism in terms of Constitutional Law; Today, we aim to emphasize the formation and understanding dimensions of the expression of Atatürk's Nationalism in the Constitution, and to contribute to the literature by revealing the reflections of this principle in the field of Administrative Law in the places where the Administration emerges in terms of establishment, duty, authority and activity.
