Abstract (EN)

In this study, the way hate speech is handled in conceptual, definitive and international documents will be examined, taking into account the damages that hate speech causes and can cause in society. The European Court of Human Rights' approach to hate speech between freedom of expression and abuse of rights will be examined. The attitude of the Constitutional Court on the issue of hate speech will be discussed within the scope of individual application decisions. The approaches of both courts will be compared and solutions to the problem of hate speech will be presented.
