Right to be tried within a reasonable time and duration of arrest in accordance with the human rights court of decisions.

The subject of this thesis is right to be tried within a reasonable time and duration of arrest in accordance with the Human Rights Court of Decisions. The most decisions of violation which has given against Turkey from European Court of Human Rights are about right to be tried within a reasonable time. Because of this we generally explained the right to a fair trial. Firstly we gave general information about the right to a fair trial and the history of the right to a fair trial. Finally we gave information about other factors of the right to a fair trial. In the second section of the first part of the study we explained right to be tried within a reasonable time. In this section we expressed how they are determined by the calculation of a reasonable time interval by the European Court of Human Rights have been introduced. In the last section of the first part of the study we mentioned about the measures that are taken by the government to ensure the right to trial within a reasonable time in proceedings in our country. In the second part of the study, arresting is explained in general terms. In this context, the second part of the arresting agency is one of the first measures for the protection and general information about the institution known as the doctrine of the different definitions are given. Also the material and shape of the conditions that are need to apply for arresting where the measure is introduced. In this chapter,we mentioned about crimes that are called catalog crimes in doctrine and are received as the reasons of the arresting. In the final part of the study, according to national legislation, the maximum period of detention statements about making reference to the doctrine of the period of detention is given in the discussions. Additionally The European Court of Human Rights against Turkey in relation to periods of detention up to date with the decisions given by the application tried to attract attention to a conspicuous inaccuracies.
