Abstract (EN)
As one of the most important international convention in the field of human rights, The European Convention on Human Rights (ECHR) and the decisions of the European Court of Human Rights regarding fundamental rights and freedoms in this convention have strongly influenced internal law for many years. In this sense, the interaction between the Court of Cassation and the Convention has a significant role in doctrine and practitioners. First of all, the concept of human rights, The European Convention on Human Rights and the European Court of Human Rights are emphasized in this study. Then, the main issue of the study is examined after referring to impact of the international conventions, particularly the ECHR, on Turkish law. The point of view of the Court of Cassation's Criminal Chambers regarding the subject is tried to be reflected from the current leading case law as much as possible.
