Özet (EN)

In the widest sense, torture which means performing agonizing acts to anyone materially and morally has been widely used as a way of penalization and questioning from past to present. With this aim, torture having had a wide range of applications in medieval age has been banned without exception in our time, being the subject-matter of many international documents. In this study, elaborates the first European Convention on Human Rights, then the crime of torture defined in Article 3 of the Convention and the 5237 Turkish Penal Code Articles 94 and 95 are discussed with all its elements. After that 12 September 1980 military coup period was examined conditions, disruptions caused by these conditions has been evaluated in detail within the framework of European Convention on Human Rights. Finally the deep scars left by torture are mentioned on the victims.
