Allocation concept in et-Taqrîb ve'l-Irshâd By Aqillânî

ABSTRACT Mehmet Nezir Ceylan, "Allocation Concept in et-Taqrîb ve'l-Irshâd By âqillânî", Institute of Social Science of Dicle University, Master Thesis, Superviser: Nihat Tosun, Assistant Professor Order and prohibition (amr and nahy), which forms the backbone of the shariya laws is one of the most important subjects of fiqh. Drawing the borders of the social life according to the Shariya scholar requires knowing this subject thoroughly. Our thesis processes the order and prohibition (amr and nahy) subject within the frame of Al Baqillani's -who systematizes the Mutakkallim method (Usul Mutakallimin) after Al-Shafii and influences the methodists after them- at-Taqrîb ve'l-Irshâd as Sagir work. Within the framework, order and prohibition (amr and nahy) terms are tried to be analyzed from the perspective of Waqfiyye school of which he was a member. This thesis analyses and presents the discussions between the different schools about the meanings, attributed to the terms from the perspective of Al Baqillani. Our thesis is comprise of an introduction, three parts and a conclusion. In the introduction, the scope and the method are discussed. In the first part, Al Baqillani's life, his scientific development, his teachers, his works and his et-Taqrîb work which is the source of our study are mentioned. In the second part, after the definition of order (amr) and its main matters are mentioned, the concept of order (amr) is analyzed from the perspective of Al Baqillani. In the third part, after the prohibition (nahy) concept is addressed in general, Al Baqillani's opinions about the subject are processed.As a result, we tried to give Al Baqillani's order and prohibitions, and the meanings that he give to these concepts.
