Liability of building and construction work proprietor

In this thesis, the responsibility of the owner of the damage arising from the building and property, which has a very important place in the application, was discussed. In this respect, after the definition of the concept of responsibility and the place of responsibility in Turkish Law were examined, the responsibility of the owner for the building and property, which is our subject, and the conditions necessary for the realization of this responsibility and its consequences were emphasized. In particular, the issues such as the legal nature of the building and property, the differences between the responsibility arising from the building and property and other types of responsibility, who is responsible for the damage caused, and to what extent they are responsible were discussed. Also, the parties to the compensation case to be filed for the elimination of damages, what kinds of damages can be covered by the compensation, who has the right to reclaim the damage after the compensation case were emphasized. Moreover, the regulations on what kind of changes were made on the responsibility of the building owner in the Turkish Code of Obligations no. 6098 unlike the Law of Obligations No. 818 were examined.
