Abstract (EN)

At the second section of the Turkish Civil Code under number 4721, there are judgments on family law. The marriage law prepared in the first chapter is divided into four parts. Marriage (Turkish Civil Code article 118-160), divorce (Turkish Civil Code article 161-184), general judgments on marriage (Turkish Civil Code article 185-201), property regime between the parties (Turkish Civil Code article 202-281). The main goal in a marriage is to continue the union until death. But when there are certain private conditions, it is obvious to end the marriage union. Divorce is the cause of the end of the marriage. It is a legal problem but also a serious social and economic problem. The differences of humor between the parties, the socio-cultural differences, the negative behaviors of the parties such as infidelity, indifference, lack of love which are sentimental violence; physical violence, socio-economic violence, parental interventions in the marriage union, economic problems and many other problems are the cause of disagreement between the parties. And for this reason, the marriage union ends by divorce. Divorce, which is one of the causes of the end of the marriage, ends the legal relationship between the parties and changes the legal status of the parties, earned by the marriage. The legal outcomes of divorce can be divided into two groups. The personal and financial results of the spouses and the results on the children. The personal result is the opportunity to marry someone else again and to lose the responsibilities and rights got by the marriage. The woman can use her previous name after the divorce and the spouses will lose their right to be inheritors of each other. But after the divorce, the parties do not lose their status of maturity, affinity by marriage and citizenship. Related to the common children, there are certain changes after the divorce. Guardianship of the child or children who are not minors is given to one of the parties. Individual dialog is established between the child and the other parent who does not have the right of guardianship according to certain rules. The parent who does not have the right of guardianship can contribute to the costs of education, protection, housing his child who lives with the other parent. This is called as the participation allowance. As you know, marriage is an economic cooperation between the parties. For this reason, after the divorce, it appears some economic results. These results can be summarized as the end of the property regime between the parties, the material and moral indemnity and the poverty indemnity. These subjects are important in relation to legal institutes and other establishments concerned and as well as for the life relations. Serious problems are observed by applying them in life. The most common problems about divorce in practice are financial problems. Above all, we must carefully consider whether it is a question of ordering on moral and material indemnity and poverty indemnity. And it is also necessary to define the content and the limits of these allowances. The main subject of our study is the material and moral indemnity and also the poverty indemnity which are the financial results of divorce. There are articles on this subject in the Turkish Civil Code of 4721 among articles 174-178. We have chosen this subject because the main lines of material and moral indemnity and poverty indemnity are ordered in the relevant law. The reasons for ordering compensation or an alimony are generally regulated by case law of the Court of Cassation. The fault status of the parties in the divorce is important to decide on the material and moral indemnity and the poverty indemnity. The fault analyzes change depending on the case. In article 174/1 of the Turkish Civil Code organizing the material allowance, it is spoken of the present interest and the awaiting interest. In order to obtain a material compensation, the interest in question must be damaged. But definitions of the concepts of present and expected interest are not given. The content and limits of the present and expected interest are not explained. In article 174/2 of the Turkish Civil Code organizing moral indemnity; it is said that the personal rights must be attacked in order to obtain it, but the definition of personal right is not given in the relevant law. In judgment 175 of the Turkish Civil Code organizing the poverty allowance, it is said that the husband or wife must be poor but the definition of poverty is not given. The lack of definition in these articles are not omitted. This legal loophole is made on purpose. The aim is not to limit this concept. It is the judge who will decide on this matter. For this reason, the conditions of compensation and alimony change case by case. In some divorce disputes, these conditions have not been met. Other than that, when calculating the amount of material and moral compensation and poverty compensation, the laws do not have a stable formula. In general, when the legal Turkish family form is considered, the judge has a great deal of freedom to order and an union does not exist in practice on this matter. Because of these reasons, this subject must be taken in hand with all the details. In this study, we have taken advantage of the Turkish works in doctrine. Our thesis is supported by case law obtained from case law banks and other resources. Likewise, we have presented the differences of judgment between the Turkish Civil Code under number 743 and 4721. The subject of our study is the financial results of divorce. But the liquidation of the property regime between the parties is a very broad subject, for this reason we have touched on said subject in summary. We have studied them in the light of the material and moral indemnity organized in article 174 of the Turkish Civil Code, the doctrinal thoughts of the poverty allowance organized in article 174 of the Turkish Civil Code and the decisions of the Court of Cassation. The subject of our study is the material and moral indemnity and the poverty indemnity which are the financial results of divorce. For this reason, we briefly talked about the legal results of divorce in the introduction. In the first chapter, we examined the material and moral allowance and in the second chapter the poverty allowance. In the first part of the first chapter, we touched on the purpose of material compensation, its properties and its legal type, the conditions of the material allowance, how to decide the amount of the material allowance, the means of payment of the material allowance, the change of the amount of the material allowance and its termination. Lately, we have been talking about formal judgments on material compensation. In the second part of the chapter we explained in detail the purpose of moral indemnity, its properties and its legal type, the conditions of the moral indemnity, how to decide the amount of the moral indemnity, the ways of payment of the moral indemnity, the formal judgments on the moral indemnity and in case of the infidelity of one of the parties, whether the third party has to pay moral indemnities. The second chapter of our study is devoted to the poverty allowance. As such, we have underlined the purpose of the poverty allowance, its properties and its legal type, the conditions of the poverty allowance, the duration of the poverty allowance, how to decide the amount of the poverty allowance, the means of payment of the poverty allowance, the end of the poverty allowance, the change in the amount of the poverty allowance, that is to say its increase, its reduction, while taking into consideration the coming years and lately we have been talking about formal judgments on the poverty allowance. Au deuxième cahier de Code Civil Turc sous numéro 4721, il existe des jugements sur le droit de famille. Le droit de mariage préparé au premier chapitre est divisé en quarte parties. Le mariage (Code civil Turc article 118-160), le divorce (Code Civil Turc article 161-184), les jugements généraux du mariage (Code civil Turc article 185-201), régime des biens antre les parties (Code civil Turc article 202-281). Le but dans le mariage est de poursuivre l'union jusqu'à la mort. Mais quand il arrive certaines conditions privées, il est évident de terminer l'union du mariage. Le divorce est la cause de la fin du mariage. C'est un problème juridique mais aussi un grave problème social et économique. Les différences d'humour entre les parties, les différences socio-culturelles, les comportements négatifs des parties comme l'infidélité, l'indifférence, manque d'amour qui sont des violences sentimentales; violence physique, violence socio-économique, les interventions des parents à l'union de mariage, des problèmes économiques et plusieurs autres problèmes sont la cause de mésentente entre les parties. Et pour cette raison, l'union de mariage se termine par le divorce. Le divorce qui est l'une des causes de fin du mariage, termine la relation juridique entre les parties et change les statuts juridiques des parties, gagnés par le mariage. Les résultats juridiques du divorce peuvent être divisés en deux groupes. Les résultats personnels et financiers des époux et les résultats sur les enfants. Le résultat personnel est l'opportunité de se marier à nouveau avec quelqu'un d'autre et de perdre les responsabilité et les droits apportés par le mariage. La femme peut prendre son nom précédent suite au divorce et les époux vont perdre leur droit d'être héritier. Mais suite au divorce, les parties ne perdent pas leurs statuts de maturité, l'affinité par mariage et de citoyenneté. A propos des enfants communs aussi, il existe certains changements après le divorce. La tutelle de l'enfant ou des enfants qui ne sont pas mineurs est donnés à l'une des parties. Le dialogue individuel est établi entre l'enfant et l'autre parent qui n'a pas le droit de tutelle selon certaines règles. Le parent qui n'a pas le droit de tutelle peut contribuer aux frais d'enseignement, de protection, de loger son enfant qui vit chez l'autre parent. Ceci est appelé comme l'indemnité de participation. Comme vous le savez, le mariage est une coopération économique entre les parties. Pour cette raison, suite au divorce, il en résulte certains résultats économiques. Ces résultats peuvent être résumés comme la fin du régime des biens entre les parties, l'indemnité matérielle et morale, l'indemnité de pauvreté. Ces sujets sont importants par rapport aux instituts juridiques et aux autre établissements concernés et aux relations de vie. Il est observé des problèmes graves en les appliquant dans la vie. Les problèmes les plus fréquentés sur le divorce dans la pratique est des problèmes financiers. Surtout il faut bien examiner s'il s'agit d'ordonner sur l'indemnité morale et matérielle et l'indemnité de pauvreté. Et il faut aussi définir le contenu et les limites de ces indemnités. Le sujet principal de notre étude est l'indemnité matérielle et morale et aussi l'indemnité de pauvreté qui sont les résultats financiers du divorce. Il y a des articles sur ce sujet dans le Code civil Turc de 4721 parmi les articles 174-178. Nous avons choisi ce sujet car les lignes principales de l'indemnité matérielle et morale et l'indemnité de pauvreté sont ordonnés dans la loi concernée. Les raisons d'ordonner à une indemnité ou à une pension alimentaire sont réglés généralement par des jurisprudences de la Cour de Cassation. L'état de faute des parties dans le divorce est important à décider à l'indemnité matérielle et morale et à l'indemnité de pauvreté. Les analyses des fautes changent selon le cas. Dans l'article 174/1 de Code Civil Turc organisant l'indemnité matérielle, il est parlé de l'intérêt présent et l'intérêt qui attend. Afin d'obtenir une indemnité matérielle, l'intérêt en question doit être endommagé. Mais les définitions des concepts d'intérêt présent et qui est attendu, ne sont pas données. Le contenu et les limites de l'intérêt présent et qui est attendu ne sont pas expliqués. Dans l'article 174/2 du Code civil Turc organisant l'indemnité morale, les droits personnel doivent être attaqué afin de l'obtenir mais la définition du droit personnel n'est pas donné dans la loi concernée. Dans le jugement 175 du Code civil Turc organisant l'indemnité de pauvreté, il est dit que l'époux ou l'épouse doit être pauvre mais la définition de pauvreté n'est pas donnée. Les manques de définition dans ces articles ne sont pas omis. Cette lacune de loi est faite par exprès. Le but est de ne pas limiter ce concept. C'est le juge qui va décider sur ce sujet. Pour cette raison, les conditions de l'indemnité et la pension alimentaire changent selon le cas. Dans certains litiges du divorce, ces conditions n'ont pas eu lieu. A part ça, au calcul du montant de l'indemnité matérielle et morale et l'indemnité de pauvreté, les lois n'ont pas une formule stable. En général, quand la forme juridique de famille Turque est examinée, le juge possède une grande liberté d'ordonner et une union n'existe pas dans la pratique à ce sujet. A cause de ces raisons, il faut prendre en main ce sujet avec tous les détails. Dans cette étude, nous avons profité des œuvres en Turc dans la doctrine. Notre thèse est supportée par des jurisprudences obtenues des banques de jurisprudence et des autres ressources. De même, nous avons présenté les différences de jugement entre le code civil Turc sous numéro 743 et 4721. Le sujet de notre étude est les résultats financiers du divorce. Mais la liquidation du régime des biens entre les parties est un sujet très large, pour cette raison nous avons touché ledit sujet en résumé. Nous les avons étudié sous la lumière de l'indemnité matérielle et morale organisées dans l'article 174 du Code civil Turc, les pensées de doctrine de l'indemnité de pauvreté organisé dans l'article 174 du Code civil Turc et les décisions de la Cour de Cassation. Le sujet de notre étude est l'indemnité matérielle et morale et l'indemnité de pauvreté qui sont les résultats financiers du divorce. Pour cette raison, nous avons brièvement parlé des résultats juridiques du divorce à l'introduction. Au premier chapitre, nous avons examiné l'indemnité matérielle et morale et au deuxième chapitre l'indemnité de pauvreté. A la première partie du premier chapitre, nous avons touché le but de l'indemnité matérielle, ses propriétés et son type juridique, les conditions de l'indemnité matérielle, comment décider le montant de l'indemnité matérielle, les voies de paiement de l'indemnité matérielle, le changement du montant de l'indemnité matérielle et sa fin. Dernièrement, nous avons parlé des jugements de forme sur l'indemnité matérielle. A la deuxième partie du chapitre, nous avons expliqué en détail le but de l'indemnité morale, ses propriétés et son type juridique, les conditions de l'indemnité morale, comment décider le montant de l'indemnité morale, les voies de paiement de l'indemnité morale, les jugements de forme sur l'indemnité morale et en cas de l'infidélité de l'une des parties si le tiers doit payer des indemnités morales. Le deuxième chapitre de notre étude est réservé à l'indemnité de pauvreté. A ce titre, nous avons souligné le but de l'indemnité de pauvreté, ses propriétés et son type juridique, les conditions de l'indemnité de pauvreté, la durée de l'indemnité de pauvreté, comment décider le montant de l'indemnité de pauvreté, les voies de paiement de l'indemnité de pauvreté, la fin de l'indemnité de pauvreté, le changement du montant de l'indemnité de pauvreté, c'est-à-dire son augmentation, sa réduction, tout en prenant en considération les années à venir et dernièrement, nous avons parlé des jugements de forme sur l'indemnité de pauvreté.
