Framework agreements in labour relations

Framework agreement is a standardized agreement type used to determine general principles and minimum common elements in regard to multi-level legal transactions of the parties as in the other branches of law, also in the field of labour law. International framework agreements signed with the multinational companies and also which contribute to applying and determining minimum labour standards and sectoral and inter-sectoral framework agreements made at level of the European Union Law, which also support the conformity of national labour relations occupy important position in international labour relations. It is clearly seen that the forms of framework agreements used for national based labour relations vary in content and components peculiar to each country. The framework agreement regulated legally for the first time in our country with the help of Trade Unions and Collective Bargaining Agreement Act, No. 6356, is highly different from the former implementations in the other countries in terms of parties, content, establishment,form, legal characteristics. In case of implementing the regulations of this agreement that haven't been implemented since the code came into force,it is possible to experience several problems due to inadequate and ambiguous regulations. In study, framework agreement in labour relations and the implementations provided with this feature are analyzed by taking into consideration the system of the national labour relations in Turkey and the other foreign countries,the implementations at level of European Union Law and international framework agreemnts.In the first part,mainly,the notion of the framework agreement and the place of framework agreemens in international labour relations are presented. Within this scope, in addition to sources related with the law of obligations,the views of the teachings, research reports that examine the implementations of the agreements are used. In the second part,the place of the framework agreements in labour relations of Turkey is explained within the context of face to face meetings with the related parties,former implementations similar to the feature of the framework,the disputes of doctrines and current regulations.
