Termination of the player contracts with just causein the light of CAS and FİFA jurisprandence

ABSTRACT TERMINATION OF THE PLAYER CONTRACTS WITH JUST CAUSE IN THE LIGHT OF CAS AND FIFA JURISPRANDENCE Of all the sports globally, football is one of the most advanced industries. Among the most significant relationships in football law are professional football player contracts, which is the subject of our study. Disputes related to international player contracts are resolved by CAS and FIFA. FIFA is the highest authority in the world concerning the governance of football. The Dispute Resolution Chamber (DRC), which is FIFA's judicial body, is the competent authority for resolving disputes between clubs and players. When evaluated in the context of our study, CAS serves as an independent and impartial court specializing in sports, acting as the appellate body for DRC decisions. The parties to a player contracts, which forms the basis of football law, are the club and the player. Players are the reason for the large budgets allocated each season to create the right team and lead clubs to success. It is crucial to determine the obligations of the parties involved in the football player contract. In the event of a breach of these obligations, the FIFA regulation RSTP (Regulation on the Status and Transfer of Players), DRC decisions, and CAS rulings provide guidance on the matter. The justified termination reasons resulting from the breach of obligations cannot be fully understood from the RSTP alone. CAS and FIFA decisions fill the gaps regarding the reasons and consequences of terminations with just cause. The purpose of our study is to make inferences about the establishment, structure, and judicial procedures of CAS and FIFA, the principles related to professional football player contracts, and the termination with just cause conditions and consequences of these contracts in light of CAS and FIFA decisions.
