The misdemeanour of causing to realisation of the procedure of dud check

The preference of using check became common with the development of the commercial activity. The law numbered 3167 and dated 19.03.1985 was inforced in order to increase the confidance of payments that were paid using check and to hinder the provision of check, in the course of time the necessity of preparing a new check code became urgent because this law can not be satisfactory for necessities that change and increase as well. For this reason a new check code numbered 5941 was inforced in 20.12.2009; in this new law, some changes were made with the law numbered 6273 in 31.01.2012. With the principle of Criminal Law ?economic punishment for economic crime? and according to the jurisdiction which takes place in 38th article of the Constitution ?No one can be detained from his liberty because of non performance of obligation that come to light only with a contract? The act of payment using a check without provision wasn't accepted as a crime, but it was accepted as a misdemeanour owing to the criticisms and administrative sanction was kept in mind in return for it.With this work we wanted to observe and evaluate the innovations and the basis of responsibility that were made due to the misdemeanour causing a procedure that is realised with a payment which was paid using a check without provision with the check code 5941.
