Cessâs' attitude towards spousal verses

Abstract (EN)

Ahkâm commentaries are works which occupy an important position in terms of Islamic law and which explain the verses declaring provisions in Qur'an. In this study, the life of Hanafi Scribe Ebû Bekr-el Cessâs, which lived through the 4th century of Hegira, his attitude towards spousal verses in his work named Ahkâmu'l Qur'an and some preferences of him were analyzed. This study consists of three main sections. The first section includes both the information about the political, social, scientific and cultural situation during the term that Cessâs lived through and the life of Cessâs, his scientific personality, masters educating him, his students and works. One of the key issues of Islamic Family Law which is marriage is outlined at the second section of the study. Legal requirements of wedding contract and requirements supplying it to be valid, people in terms of qualification, the role and the effect of parents' in wedding contract, marriage deal breakers and the issue of bride wealth which is a result of a legal wedding are examined in the bases of Hanafism and from the view of other denominations as the occasion arises. The third section, which is the basis of the study, includes some preferences and comments about some spousal issues which Cessâs mentioned in his work Ahkâm'ul Qur'an.
