Abstract (EN)

In today's world, the increasingly significant impact of the digital realm on our lives complicates the task of defining the boundaries of cybercrimes. Within this context, the unauthorized hijacking of online game accounts and game characters, and determining their legal status, is of great importance. Online games and game characters often represent digital assets developed and personalized by users through significant time, effort, and even financial resources. Identifying the legal status of these assets is crucial for defining the legal framework of unauthorized access and similar offenses. The goal is to evaluate the act of unauthorized hijacking of online game accounts and game characters within the scope of cybercrimes and to establish the legal rights of users and states against such actions. In this framework, it is important to determine how legal regulations should be shaped to effectively combat these crimes and punish the perpetrators. It is argued that the unauthorized hijacking of online game accounts and game characters should be treated similarly to unauthorized access, violation of digital property rights, and even theft. Understanding and defining the unique characteristics of the digital world and the rights of users to their digital assets will determine how these actions are legally evaluated. Legal regulations regarding the unauthorized hijacking of online game accounts and game characters will aid in the broader development of cybercrime law and digital property rights. In this regard, the effectiveness of the law, the achievement of justice, and efforts to protect digital rights should align with the general objectives of preventing crimes in the digital world and protecting users.
