Maritime transportion issues in Competition Law: Abuse of dominant power in the market

Maritime transport has a strong relationships with international trade and remains the most efficient and economical form of transport. Today, about %85 of world trade is provided by maritime transport. The very severe competition in maritime transport makes it different from other big sector . This thesis deals with competition law and practice in maritime transport with specific reference EU and Turkey, and it incorporates many disciplines. Firstly, distribution channels and types of maritime transport have been examined in detail. In terms of competition law, the determination of dominant power in the market, situations of the abuse of dominant power and the doctrine of essential facilities have been examined. Also EU Commission and Turkish Competition Authority's Board decisions relating to maritime transport have taken place in this study. Maritime transport is still developing industry in Turkey. Therefore, this situation bring about many problems in terms of competition law . The abuse of dominant power, which is one of the most common violations of competition in maritime transport, has been examined in detail.
