This right could be advanced while sharing out theinheritance or refining the property regime. The spouse who is qualified toadvance this right, must have preponderant rights or must be alive. Due tothis right the spouse could have some real rights on certain property value.This right which is arranged in our civil law is appropriated for developmentsand reforms about familiy law. It has qualities to protect the spouses andcontains two different kinds of goods.The first group of them are goods in the spouse?s shared property. Oncondition paying, the spouse preponderant rights on these goods, could takeother spouse?s share. In this condition the good will be given him or herwithout sharing. By this method these goods? importance for the spousestaking into consideration and probable disadvantages will be prevented.The second group of goods are family residence and household items.While sharing out the inheritence or refining the property regime because ofdeath, the spouse who is alive, could demand to have some rights on thesegoods. These rights are usufruct or to be resident on family residence or gainproperty and gain household items? property. By this method the legislator?saim of protecting the spouses could be obtained because the spouse who isalive can continue him or her life without any essential change.
