Evaluation of electronic publications in terms of Intellectual Property Law

Publishing, which is an indispensable element of cultural and scientific progress, has been carried out through printed media for literary and scientific texts for many years. However, in recent years, the developments in the fields of computer, internet and information technologies have increased significantly, and the concept of electronic publishing, which has been carried out in digital media both in the world and in our country, has emerged. In electronic broadcasting, advantages such as easy, fast and low cost access and use are; new types of problems and information security problems in terms of intellectual property violations are disadvantages. Many electronic publications are made available to the public in online digital media, especially in the Internet, or in offline digital media that are not connected to the online network. In particular, this makes electronic publications vulnerable to intellectual property violations and intellectual property problems. Unresolved problems can negatively affect the number, prevalence and commercial circulation of valuable intellectual productions in this field. Therefore, it is important to determine the necessary conditions for the subject of intellectual protection of electronic publications, to define intellectual rights from the perspective of electronic publications, violations of rights, forms of violations and methods of protection from violations. In this context, in our study, electronic publication will be conceptually discussed in terms of definition and frequently produced genres and thus the limits of our study will be drawn. Then the relevant national and international regulations will be discussed; within the framework of the basic rules of intellectual law and related legislation, in particular the Law No. 5846 on Intellectual and Artistic Works; basic concepts of intellectual law, major intellectual rights and protection against violations of rights will be examined and interpreted in terms of electronic publications. It is considered that our study will contribute to the author, the owner, the users and the libraries and other interested parties who mediate the presentation of such electronic publications to the society.
