Abstract (EN)
ABSTRACT Police forces are a natural aspect of the social structure with the responsibilities such as maintaining public order and safety, preventing crime and arresting criminals. Our society expects police forces to respect human rights in indulgence and to serve within legal boundaries instead of impolite and strict ways. Since discipline law is an emerging field, discipline applications toward public officers are not fully established in terms of both legal deficiencies and defects in application procedure. The Law of Police Forces which arranges the discipline regulations for more than tow hundred officers fails to include a fundamental arrangement of investigating police personnel. Hence, some disorganization proplems occur in discipline investigation and punishment. Institutional regulations hardly help to overcome these problems. The Law of Police Forces should be revised on how and who to investigate in general, and within this law, the regulations should be altered covering as much detail as possible. Thus, the defects in discipline investigation can be ceased. This study covers discipline as an emerging concept. This is examined by reviewing the discipline articles in the body of current law, the consultation opinions of law department of Police Forces General Directorate on discipline investigation, current applications of discipline crimes and penalties and decisions of administrative judgement commissions. It is disscussed how discipline punishment should be stuated based on the decisions of Council of State.
